User Terms & Conditions for Using Apna Artist

These Terms & Conditions govern access to and use of Apna Artist by any visitor, user, customer, event planner, organiser, business, or person using our website, app, booking system, enquiry system, payments, communications, or related services. By using the platform, creating an account, submitting an enquiry, making a booking, communicating with artists, or making a payment, the user agrees to be bound by these terms.

Booking Platform Rules

Users must use the platform honestly, follow booking rules, give correct event details, and avoid misuse of leads, artists, or payment systems.

Payments, Refunds & Deductions

Booking payments, advance amounts, refunds, cancellation deductions, gateway charges, taxes, and operational deductions may apply depending on the booking type.

No Platform Bypass

Users must not misuse artist details, bypass the platform for fraudulent side-deals, or use platform-generated contacts in bad faith.

Section 01

Acceptance of Terms and Eligibility

  • Binding digital acceptance: By accessing the platform, creating an account, submitting an enquiry, communicating through the platform, making a booking, or making a payment, the user agrees to these Terms & Conditions as a binding electronic agreement.
  • Eligibility to use: The user confirms that they are legally capable of entering into a binding agreement and that all information provided by them is accurate and not misleading.
  • Business and personal users: These terms apply to individual users, customers, event organisers, businesses, corporate clients, and any person using the platform for artist discovery, event booking, enquiry, scheduling, or payment purposes.
  • No acceptance, no use: If the user does not agree to these terms, they should not access, use, book through, or continue using the platform.
Section 02

Platform Services and Role of Apna Artist

  • Facilitation platform: Apna Artist operates as a booking, discovery, coordination, communication, and platform facilitation service for artists and customers.
  • Scope of service: The platform may allow users to browse artists, send enquiries, receive quotations, discuss event requirements, book talent, process payments, and coordinate event-related communication.
  • No guarantee of availability: Artist availability, timing, pricing, travel feasibility, event compatibility, and acceptance of an event request are subject to real-time factors and may change.
  • Reasonable efforts basis: The platform may take reasonable steps to coordinate, support, verify, and facilitate bookings, but specific outcomes can depend on artist response, event conditions, customer conduct, and operational limitations.

User Account, Enquiry and Booking Responsibilities

  • Correct information required: The user must provide accurate details including name, phone number, email, city, venue, budget, event type, event date, performance duration, and all other material event information.
  • Responsibility for event accuracy: The user is responsible for sharing complete and correct details of the event, venue permissions, timing, audience type, technical setup, travel requirements, and any special conditions or restrictions.
  • Account security: If the platform provides login or account access, the user is responsible for maintaining confidentiality of credentials and for activities carried out through their account.
  • No false enquiries: Users must not raise fake enquiries, mock bookings, spam requests, manipulative negotiations, or misleading event requests.
Section 04

Payments, Advance Amounts, Charges and Refund Position

  • Payment authorisation: By making any booking payment, advance payment, confirmation fee, token amount, convenience fee, or other transaction through the platform, the user authorises the platform to process the transaction in accordance with the booking structure.
  • Charges may apply: Platform fees, service charges, GST, gateway charges, processing charges, travel-related adjustments, cancellation deductions, or other applicable charges may be added to or deducted from a transaction.
  • Advance and confirmation amounts: Some bookings may require advance payment, token booking amount, partial payment, or full advance confirmation depending on the artist category, event date, risk profile, or booking policy.
  • Refund basis: Refund eligibility, amount, timing, and mode may depend on artist blocking, cancellation timing, event date proximity, third-party costs, platform effort, operational work already completed, and whether the artist or customer had already reserved the date.
  • No automatic full refund in all cases: A user understands that not every cancellation or booking failure will automatically qualify for a full refund, especially where date blocking, coordination work, gateway charges, artist hold, or administrative costs have already been incurred.
Section 05

User Conduct, Platform Integrity and Anti-Misuse Rules

  • No abusive behaviour: The user must not harass, threaten, insult, extort, defame, stalk, abuse, or intimidate artists, support staff, representatives, or any other person connected with the platform.
  • No fraudulent behaviour: Users must not submit fake payment proofs, false event details, forged identity information, fraudulent refund claims, deceptive chargebacks, or dishonest complaints.
  • No misuse of artist contact data: Users must not misuse artist information or contact details obtained through the platform for unlawful, defamatory, exploitative, or unauthorised purposes.
  • No illegal event use: The platform must not be used for unlawful activity, public nuisance, hate events, scams, deceptive promotions, or illegal performance arrangements.
  • Respect event and safety conditions: Users are responsible for maintaining safe event conditions, legal venue permissions, event timing compliance, audience appropriateness, and respectful treatment of artists and staff.

Strict Misuse Clause

If a user makes fake bookings, misuses artist data, manipulates payments, files dishonest complaints, threatens an artist or platform representative, or otherwise harms platform trust, the platform may cancel bookings, suspend access, restrict services, block future bookings, retain evidence, and take recovery or legal action as permitted by law.

Section 06

No Unauthorised Bypass or Off-Platform Abuse

  • No bad-faith circumvention: Users must not misuse the platform only to collect artist details and then attempt to deceive, pressure, or exploit artists or coordinators outside the intended booking flow.
  • No platform misuse: Users must not copy, scrape, extract, republish, resell, mass-download, or commercially misuse platform content, artist listings, media, or booking information without written permission.
  • Lead protection: Where the platform has introduced, matched, negotiated, or coordinated an artist booking, the platform may treat related communications, date blocks, and booking activity as part of its protected business flow.
  • Good faith booking use: The user agrees to use artist and booking information only for genuine enquiry, event planning, confirmation, and lawful related communication.
Section 07

Artist Performance, Delays and Service Limits

  • Event dependence: Artist performance can be affected by traffic, weather, emergency conditions, venue restrictions, government orders, local disturbances, technical limitations, force majeure events, health emergencies, or other factors beyond reasonable control.
  • Reasonable coordination standard: The platform may coordinate and support performance delivery, but cannot guarantee that every factor outside its control will always remain perfect.
  • User cooperation needed: Users must provide proper event coordination, venue entry, stage setup, technical access, timing discipline, and necessary event permissions.
  • Performance changes: Last-minute user-side changes in venue, time, duration, travel route, audience type, event format, or special demands may affect pricing, availability, refund status, or booking continuation.
Section 08

Content, Platform Rights and Intellectual Property

  • Platform ownership: Platform branding, logos, layout, booking system design, text, graphics, technology, and platform content remain the property of the platform or its licensors unless expressly stated otherwise.
  • Limited user access: The user receives only a limited, revocable, non-transferable right to use the platform for lawful personal or internal business booking purposes.
  • No copying or resale: Users may not copy, reverse engineer, scrape, republish, repurpose, distribute, sell, or commercially exploit platform content or systems without written authorisation.

Suspension, Cancellation and Enforcement Rights

  • Right to suspend or restrict: The platform may suspend, restrict, refuse, cancel, hold, or terminate any account, enquiry, booking, or access where it reasonably believes there is fraud, risk, abuse, policy breach, payment irregularity, false information, or legal exposure.
  • Booking cancellation rights: The platform may cancel or pause a booking where required for safety, compliance, artist protection, customer protection, fraud review, non-payment, or operational impossibility.
  • Evidence preservation: The platform may retain chat logs, booking records, payment records, complaint records, screenshots, and operational data for review, defence, compliance, or legal action.
  • Recovery rights: In appropriate cases, the platform may seek recovery of dues, losses, costs, damages, or other amounts lawfully claimable due to misuse, fraud, or wrongful conduct by a user.
Section 10

Final User Consent and General Legal Position

By continuing to use the platform, the user acknowledges that they have read and accepted these Terms & Conditions and agree to use the platform lawfully, honestly, and in good faith.

  • The user agrees that bookings, payments, enquiries, communications, and platform access are subject to these terms.
  • The user agrees that charges, taxes, refund adjustments, and operational deductions may apply depending on the transaction and booking structure.
  • The user agrees not to misuse platform content, artist details, enquiry systems, payment systems, or customer support channels.
  • The user agrees that fake bookings, fraud, abusive conduct, policy violations, or harmful misuse may lead to suspension, cancellation, access restriction, or legal action.
  • The user agrees that electronic use of the platform may create a binding record of acceptance, communication, booking activity, and transaction history.
