Artist Terms & Conditions for Becoming an Artist on Apna Artist

Before any user becomes an artist on our platform, they must read and accept these terms. These terms govern artist onboarding, identity verification, platform conduct, booking integrity, payments, commissions, taxes, content use, and enforcement rights, and are intended to protect artists, customers, events, venues, and the platform ecosystem.

ID & Safety Verification

We may collect artist identity details and one valid government-issued ID for authenticity verification, fraud prevention, customer protection, internal compliance, and safer bookings.

Commission & Tax Deductions

Platform fees, GST, gateway costs, refunds, reversals, chargebacks, or other lawful deductions may be adjusted before artist settlement.

No Direct Client Bypass

Artists must not bypass the platform, take platform-generated clients directly, or misuse the brand name to secure or collect off-platform payments.

Important Highlights

Acceptance is mandatory If the user does not agree to these terms, the artist profile must not be created.
Commission range Commission may be deducted from 10% to 45%, excluding applicable taxes, based on category, city, service model, effort, and commercial structure.
Settlement hold window Payments may be held from 3 to 30 days after performance for safety, service confirmation, complaint handling, refund checks, or dispute review.
Overtime reporting required If an artist performs extra hours or added services beyond the booked scope, the same must be reported through the app or official platform support.
Section 01

Eligibility, Consent and Registration Access

  • Binding acceptance: By proceeding with artist registration, submitting profile information, uploading documents, or using any equivalent acceptance step in the app or website, the applicant confirms that these terms have been read, understood, and accepted as a binding digital agreement.
  • No agreement, no profile: If the applicant does not agree to these terms in full, the applicant must not continue registration and no artist profile should be created.
  • Eligibility declaration: The applicant declares that they are legally competent to enter into a valid contract and that all information submitted is accurate, current, complete, and not misleading.
  • Review and approval discretion: Registration submission does not guarantee approval, listing, promotion, lead assignment, booking access, or continued platform availability. The platform may approve, reject, hold, suspend, review, restrict, unpublish, or remove any artist application or profile at its reasonable discretion for safety, fraud, compliance, legal, quality, or operational reasons.
Section 02

Artist Information, Government ID and Lawful Data Use

To support safer onboarding and responsible marketplace operations, the platform may collect and process artist information including name, phone number, email, city, state, stage name, category, performance details, photographs, social links, payment details, booking history, communications, and one or more government-issued identity documents where reasonably required.

  • Purpose of collection: Information may be collected and processed for registration, identity verification, authenticity review, fraud prevention, payment processing, service delivery, customer safety, event management, grievance handling, platform operations, compliance, record keeping, and lawful enforcement.
  • ID verification: A government-issued ID may be requested or retained for the lawful purpose of verifying identity, reducing impersonation, limiting fake registrations, improving customer trust, and supporting internal safety controls.
  • Limited sharing principle: Artist registration data is not intended for casual public disclosure or open sale to third-party vendors. Information may however be shared, disclosed, preserved, or produced where reasonably necessary for payment processing, hosting, platform support, technical operations, complaint handling, fraud prevention, compliance, legal process, law enforcement requests, or protection of the platform’s legitimate interests.
  • Record retention: The platform may retain registration records, uploaded documents, screenshots, communications, booking logs, payment traces, support tickets, and related operational records for audit, dispute handling, safety review, recovery action, legal compliance, evidence preservation, and platform protection for as long as reasonably necessary.
  • Accuracy obligation: The artist must keep profile information truthful and updated. False, forged, expired, manipulated, or misleading documents or declarations may result in rejection, suspension, payout hold, or permanent removal.
Section 03

Platform Fees, Commission, GST and Settlement Rules

  • Commission authorisation: The artist expressly authorises the platform to deduct commission from 10% to 45%, excluding applicable taxes, depending on artist category, city, service level, marketing expenditure, negotiation effort, campaign cost, customer acquisition cost, risk profile, support burden, or other commercial factors determined under the platform’s business model.
  • Tax and cost deductions: Applicable GST, payment gateway charges, settlement charges, refunds, reversals, chargebacks, promotional offsets, compensation adjustments, and other lawful deductions may be adjusted from the gross or net payable amount depending on the transaction structure and applicable law.
  • Independent tax responsibility: Unless expressly agreed in writing, the artist remains independently responsible for their own tax registration, filings, declarations, invoices, books, professional receipts, and related legal compliance. Any tax handling by the platform for a transaction does not by itself transfer all independent tax obligations of the artist to the platform.
  • Payment hold period: To protect customers, confirm performance completion, review complaints, verify quality, manage refunds, address chargeback exposure, or investigate suspicious conduct, the platform may hold artist payment for a minimum of 3 days and up to 30 days after performance completion. Where a genuine dispute, fraud review, legal demand, or material risk exists, payment may be held for a longer reasonable period.
  • Overtime and added services: If the artist performs extra hours, additional sets, overtime, upgraded service, add-on performance, or any extension beyond the confirmed booking scope, the artist must report the same through the app or official support channel promptly and accurately.
  • No unconditional instant payout: All settlements remain subject to booking completion, service validation, customer safety review, refund status, payment confirmation, operational verification, compliance review, and absence of unresolved disputes or claims.
Section 04

Artist Conduct, Booking Honesty and Anti-Circumvention

  • No client bypass: The artist must not directly or indirectly bypass the platform to contact, convert, solicit, negotiate with, or accept direct payment from any client, lead, organiser, venue, or booking contact introduced, connected, or facilitated through the platform.
  • No misuse of platform name: The artist must not use the platform’s name, goodwill, listing, lead source, campaign, brand identity, customer relationship, or booking channel to create an off-platform transaction or collect money without written authorisation.
  • Mandatory transparency: If any repeat event, referral booking, extension show, after-party, upgraded package, overtime request, or related opportunity arises from a platform-originated lead or customer relationship, the artist must disclose and report it truthfully to the platform.
  • No misrepresentation: The artist must not provide false documents, fake reviews, manipulated achievements, misleading social proof, false category claims, fake availability, inaccurate performance history, or deceptive pricing or booking promises.
  • Professional conduct required: Harassment, abuse, threats, fraud, intoxicated misconduct, unsafe behaviour, hate speech, unlawful activity, serious indiscipline, or any conduct that harms customers, venues, minors, event safety, public reputation, or platform trust may result in immediate restriction, suspension, or removal.

Strict Protection Clause

If an artist bypasses the platform, secretly deals with platform clients, hides booking-related revenue, misuses the platform’s name, or damages platform trust or customer relationships, the platform may suspend or terminate the profile, withhold or adjust settlement, reverse benefits, restrict future access, and pursue appropriate contractual, civil, criminal, recovery, or injunctive remedies as permitted by law.

Section 05

Verification Rights, Review Rights and Enforcement Action

  • Verification rights: The platform may request supporting documents, additional ID proof, address proof, performance evidence, event proof, payment proof, declarations, or clarifications during onboarding or any time during account use where reasonably required.
  • Review rights: The platform may review booking logs, uploaded media, event information, service records, customer communications, complaint histories, payment records, profile edits, and other evidence for quality control, trust, risk, and compliance purposes.
  • Restriction and removal: The platform may warn, limit, pause, unlist, shadow-restrict, suspend, withhold, or permanently remove any artist profile where it reasonably believes that fraud, impersonation, serious complaint history, direct client diversion, unsafe behaviour, policy violation, or legal exposure exists.
  • Payout withholding and set-off: Pending payouts may be withheld, adjusted, or set off against refunds, chargebacks, customer compensation, losses, investigation costs, or verified breach-related liabilities where lawfully permissible.
Section 06

Artist Content, Profile Use and Platform Display Rights

  • Content ownership and permission: By uploading photos, videos, audio, descriptions, social links, biographies, event media, and related materials, the artist confirms that they own such content or have the lawful right to use and submit it.
  • Display and promotion licence: The artist grants the platform a non-exclusive, revocable, royalty-free right to host, reproduce, adapt for display formatting, publish, list, and use approved profile content for app display, website listing, lead presentation, booking support, internal promotions, campaign creatives, customer previews, and reasonable business marketing connected with platform operations.
  • Moderation rights: The platform may edit, crop, hide, reject, remove, or moderate any content that appears unlawful, unsafe, misleading, low-quality, infringing, fake, abusive, or inconsistent with platform standards.
Section 07

Disputes, Records and Cooperation Duty

  • Official communication channels: For booking changes, service issues, settlement review, complaint response, overtime claims, cancellations, or dispute handling, artists must use the app or official platform support channels.
  • Use of platform evidence: Booking records, timestamps, uploaded files, call or chat logs, customer statements, payment proof, screenshots, ticket records, support histories, and system-generated entries may be used for internal review, evidence preservation, recovery action, and legal defence.
  • Cooperation obligation: The artist agrees to cooperate honestly, promptly, and in good faith in verification requests, complaint review, refund handling, payment investigation, safety concerns, or lawful process relating to their account or services.
Section 08

Final Artist Consent and Governing Position

By proceeding to become an artist on the platform, the applicant acknowledges and agrees that identity verification may be carried out, registration data may be processed for lawful operational purposes, commission and applicable taxes may be deducted, payouts may be held for safety and dispute reasons, content may be displayed for platform business purposes, and enforcement action may be taken for client bypass, brand misuse, dishonesty, fraud, or harmful conduct.

  • The artist agrees that one or more identity proofs may be requested for registration safety, authenticity, trust, and lawful compliance.
  • The artist agrees that the platform may deduct commission from 10% to 45%, excluding applicable taxes, in accordance with its business and service model.
  • The artist agrees that payment may be held for 3 to 30 days after event completion, or longer where a genuine dispute, fraud concern, or legal review exists.
  • The artist agrees not to bypass the platform, directly take platform clients, or misuse the platform name for side deals or private collection of payments.
  • The artist agrees that verified breach, misconduct, fraud risk, customer harm, or platform abuse may result in warning, restriction, suspension, payout hold, set-off, unlisting, termination, or legal action as permitted by law.
